Commissioner Uyeda discourages regulation through enforcement

"Regulation by enforcement fails to provide the nuanced and comprehensive guidance that allows market participants to tailor their practices, and instead requires regulated entities to divine how the facts and circumstances of another case apply to their own business model. Market participants should be able to look to the Commission’s rules rather than compare how their particular facts and circumstances may differ from those in a specific enforcement case"
